La Reserva Marina Tres Palmas está amenazada por un desarrollo irresponsable que está causando que la contaminación por sedimentos fluya hacia el medio ambiente cercano a la costa. Esta contaminación está dañando el sensible ecosistema marino, incluidos los corales cuerno de alce y cuerno de ciervo amenazados, así como un lugar para surfear de clase mundial. El Capítulo de Rincón de la Fundación Surfrider hace un llamado a las agencias gubernamentales para que hagan cumplir las leyes ambientales para proteger este lugar especial. The Tres Palmas Marine Reserve is threatened by an onslaught of rampant and excessive development that violates the Clean Water Act and generates excessive runoff that carries sediment into nearshore waters. This pollution damages the sensitive marine and coastal ecosystem, including threatened elkhorn and staghorn corals, and threatens a world class surfing break.

The Surfrider Foundation Rincón Chapter and other local environmental groups are calling upon the responsible government agencies to enforce all applicable environmental and local planning laws to protect this unique and special place. Please sign the petition to demand that the state and federal regulatory agencies (EPA, NOAA, NFWS, DNER, OPGe) take decisive action to ensure that the developers of the Sueño de Aurora Project, Bellagio LLC and and all other developers operating in the watershed comply with all applicable environmental and planning laws, and their permit requirements.

Por este medio solicitamos que tomen medidas para garantizar que Bellagio LLC y otros desarrolladores en Puerto Rico cumplan con las leyes ambientales que protegen los ecosistemas marinos y las comunidades costeras de Puerto Rico. El proyecto de construcción de Finca Sueño de Aurora está provocando que grandes cantidades de sedimentos fluyan hacia la Reserva Marina Tres Palmas, que incluye corales cuerno de alce y cuerno de ciervo amenazados y un lugar para surfear de clase mundial. Como consecuencia, solicitamos que DRNA celebre una vista publica sobre el permiso UIC para el proyecto y que OGPE realice una auditoría para garantizar que el desarrollador tenga todos los permisos requeridos. También solicitamos que la OGPE celebre una vista pública en respuesta a las sobre 100 solicitudes de vista pública para discutir la consulta de construcción solicitada por Aurora’s Dream LLC (caso  2018-239609-CCO-007944).

El proyecto de construcción de Finca Sueño de Aurora ha involucrado la excavación y el movimiento de tierra significativo en el predio y  sido testigos de descargas masivas de aguas pluviales cargadas de sedimentos que fluyen desde el lugar del proyecto. Desde allí, las descargas fluyen cuesta abajo y finalmente hacia los humedales costeros y la reserva marina. Basado en estas observaciones de descargas de sedimento es evidente que el desarrollador no está instalando y / o manteniendo suficientes controles de aguas pluviales como lo requiere la Ley de Agua Limpia y los permisos y regulaciones asociados.

El desarrollador tampoco consideró la presencia de los corales cuerno de alce y cuerno de ciervo amenazados y su designación de hábitat crítico en la reserva marina cercana, como lo requiere su permiso y la Ley de Especies en Peligro de Extinción. Algunas de las mayores amenazas para estos corales raros incluyen las fuentes terrestres de contaminación que impactan las aguas claras y bajas en nutrientes en las que prosperan. La contaminación de las aguas pluviales por el desarrollo es una de esas amenazas. La escorrentía de sedimentos y otra contaminación pueden sofocar los arrecifes, acelerar el crecimiento de algas dañinas, hacer que los corales sean más susceptibles a las enfermedades e impedir su crecimiento y reproducción.

Como agencias gubernamentales, ustedes tienen la responsabilidad de hacer cumplir la Ley de Agua Limpia, la Ley de Especies en Peligro de Extinción y otras leyes ambientales que protegen el medio ambiente cercano a la costa y las comunidades costeras. Por este medio exigimos que tomen medidas inmediatas para abordar estas flagrantes violaciones.

Dear Responsible Government Authorities,

We strongly urge you to enforce the repeated violations of planning, zoning and environmental laws by the developers of the Finca Sueño de Aurora project in Rincón, Puerto Rico (Aurora’s Dream LLC and Bellagio LLC) and ensure that all  other developers in Puerto Rico comply with all applicable laws to protect Puerto Rico’s marine ecosystems and coastal communities. 

The Finca Sueño de Aurora construction project has been causing significant amounts of sediment to flow into nearshore wetlands and the Tres Palmas Marine Reserve, a protected area which contains the last extensive system of healthy and reproducing elkhorn and staghorn corals in Puerto Rico waters and a world class surfing break. 

The Finca Sueño de Aurora construction project has involved bulldozing and significant earth movement at the hilltop site, and residents have witnessed significant sediment laden stormwater discharges flowing from the project site. From there, the discharges flow downhill and ultimately into coastal wetlands and the marine reserve. Based on the heavy sediment flows observed discharging from the site, it is evident that the developer has not maintained sufficient stormwater controls at all times throughout the ongoing construction, as required by the Clean Water Act and associated permit and regulations.  The developers are subject to Administrative Compliance Order, Docket No. CWA-02-2021-3107, but have not yet been subject to any penalties for their extensive Clean Water Act violations.  Surfrider respectfully calls on EPA to ensure the developers comply with the Order and Clean Water Act, and for EPA to hold the developers accountable for their violations with meaningful penalties.     

Further, it appears the developers failed to consider the presence of the threatened elkhorn and staghorn corals and their critical habitat designation in the nearby marine reserve, as required under its Clean Water Act Construction General Permit and the Endangered Species Act. Some of the biggest threats to these rare corals include land-based sources of pollution that impact the clear, low nutrient waters in which they thrive. Stormwater pollution from development is one such threat. Sediment runoff and other pollution can smother reefs, speed the growth of damaging algae, make corals more susceptible to disease, and impede their growth and reproduction. 

Additionally, Surfrider has concerns about the developers’ application for a septic permit for the project (UIC-21-60-0014, Permiso de Construcción, Sistema de Inyeccion Subterranea Clase V-C1, Finca Sueño de Aurora).  We urge DNER to hold a public hearing on the UIC permit as requested by Surfrider Foundation and approximately 100 community members.   Further, we implore OGPe to conduct an audit in order to ensure that the developer has and is complying with all required permits for the project.  We further request that DNER hold a public hearing as requested by Surfrider Foundation and approximately 100 public hearing requests submitted by community members regarding the construction variance requested by Aurora’s Dream LLC. We also request that OGPE hold a public hearing regarding the construction variance requested by the developers (case 2018-239609-CCO-007944).

You are responsible for the enforcement of the Clean Water Act, Endangered Species Act and other environmental laws that protect the nearshore environment and coastal communities, as well as local planning and zoning laws. Please take immediate, meaningful action to address and hold the developers responsible for any and all violations.
