ACA-7 (2023) is a new California Assembly Constitutional Amendment that intends to circumvent California's constitutional guarantee of equal treatment (Proposition 209). Even though a growing majority of California voters from all backgrounds, first in 1996 (over 55%) and most recently in 2020 (over 57%), rejected racial preferences in public education, public employment and public contracting at state ballot boxes, the radical CA lawmakers are pushing again to legalize state-sponsored racial discrimination via ACA-7.

ACA-7 has already passed the Assembly floor voting in September 2023 (Y: 62 N: 18 NV: 0 Abs: 0), and it's going to be discussed and voted in the Senate Rules Committee in January 2024. We must coalesce around the timeless principle of equality and say no to ACA-7!

I write in strong opposition to Assembly Constitutional Amendment (ACA) 7. This proposal is nothing but a de facto repeal of California’s constitutional guarantee of equal treatment, enshrined in the state constitution via Proposition 209 (1996) and reaffirmed through the recent failure of Proposition 16 (2020).

ACA-7 intends to meaningfully erode and circumvent Prop. 209. Its implementation would undoubtedly lead to racial quotas and preferences, which would also violate a series of federal legislation and the U.S. Constitution.

If you still decide to vote for this corrosive proposal against a strong bipartisan consensus against racial preferences, please note that you will:

1.  Alienate the 9.65 million Californians who already rejected Prop 16, especially Asian Americans.

2.  Waste another $20 million in public funds to campaign for an unconstitutional measure while California faces a $68 billion budget deficit.

3. Facilitate a barrage of federal lawsuits, which will succeed in shutting down everything you’re trying to do. Even the staff's analysis from the California Assembly Appropriations Committee agrees and it is also echoed in the legislative analysis that was issued on August 30th.

Please reject ACA-7!
