Any day now, we could witness the fastest expansion of the federal prison population in the history of the United States.

4,000+ people - many of whom are elderly and immunocompromised - will be sent back to prison when the pandemic is declared over, despite living successfully and safely on home confinement with their families and communities for the past year.

Biden can grant them all clemency and keep them home, but we need to move him to action.

I’m writing this letter to urge you to demand President Biden take action to protect 4,000+ people from being sent back to federal prison - simply because the Office of Legal Services issued a memo mandating it - when the pandemic is declared over.

Unless the Administration intervenes, 4,000+ people - many of whom are elders and immunocompromised - will be ripped from their homes and sent back to prison. These are people who have been safely and successfully reconnecting with their families and reestablishing community ties, as evidenced by the 99% success rate of home confinement.

Any circumstance where people are sent back to prisons is in direct contradiction to the Biden Administration's public promise to invest in ending mass incarceration. And if measures aren't taken to keep 4,000+ people at home and out of prison, this administration will be presiding over the fastest expansion of the federal prison population in history.

Biden wants to push Congress to come up with a fix, but we can’t let him pass the buck. He has the power to grant clemency now, and we demand he uses it.

Each day that Biden doesn’t grant clemency is another day that impedes people living on home confinement from making meaningful investments in their families, employment, or education - all necessary steps to fully and successfully reintegrate into and add value to their communities.

Prison facilities are not sanitary or humane spaces. And the pandemic has only worsened these conditions. People will always have a better chance at staying safe and healthy when they are at home with their communities. And it is inhumane to force people to go back to prison.

As your constituents, we are concerned that this administration will expand the federal prison population and urge you to do your part to keep people home by pushing Biden to grant clemency for all those in home confinement today!
